Aware Body & Mind Centre – Terms and Conditions
General Provisions
These Terms and Conditions govern users of Aware Body & Mind Centre. Any user is deemed to have accepted and agreed to comply with and be bound by the terms and conditions.
All Aware Body & Mind Centre users are aware of and accept the use of a Closed Circuit Television (CCTV) system and that it operates 24 hours a day or at any time. All information obtained from CCTV will be used only for security, crime prevention and related purposes. Aware Body & Mind Centre may delete information obtained from CCTV from time to time and does not represent or warrant that CCTV recording will take place at any particular time or in any particular area. Aware Body & Mind Centre makes information obtained from CCTV available to any person as Aware Body & Mind Centre deems reasonable.

“Aware Body & Mind Centre” means the business named as Aware Body & Mind Centre or the business entity specified in the Applicant’s or Client’s application form, acknowledgment, receipt or other submission.
“Centre” means a centre operated by Aware Body & Mind Centre and includes all facilities and equipment in any such centre.
“Terms and Conditions” means the terms and conditions set out in this document for access to and/or application to any Centre and any such terms and conditions as may be supplemented or amended by Aware Body & Mind Centre from time to time.
“User” means any person arriving at, visiting and/or using any Centre, including any Client or Visitor.
“Visitor” includes any person visiting any Centre, or any person invited to visit a Centre.
Collection of Personal Data
Each user acknowledges and accepts that Aware Body & Mind Centre's Privacy Policy governs the use and processing of all information provided to Aware Body & Mind Centre in connection with these Terms and Conditions.
Each user hereby authorises and consents to Aware Body & Mind Centre using his/her personal data (as defined in the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong)) for the purposes permitted by the Personal Data (Privacy) Ordinance.
Each client has the right to request access to information Aware Body & Mind Centre holds about that client and the right to require Aware Body & Mind Centre to update and correct such information. Such requests should be sent in writing to Aware Body & Mind Centre at [email protected].
code of Conduct
Each user (whether customer or visitor) acknowledges and agrees to abide by the following terms:
You may not use or display any profane, offensive, abusive or indecent language or behavior;
You must be fully responsible for keeping your personal property at all times and be liable for any loss or damage to your personal property. Aware Body & Mind Centre is not responsible for any items lost or stolen from the centre for any reason;
If any equipment or facilities of the Centre are damaged due to negligence, improper use, etc., the user shall bear and pay for the relevant losses or repair costs;
Alcohol, drugs (including steroids) and smoking are strictly prohibited within the centre. No person is allowed to visit the Centre, use the facilities in the Centre, or engage in any other activities under the influence of alcohol or drugs;
Disclaimer and Limitation of Liability
Each user agrees and acknowledges that physical training involves dangers and risks, and fully understands, agrees and accepts:
Physical fitness related training involves natural hazards and risks and the user bears full responsibility for all such hazards and risks and their consequences. If users have any questions about the above, Aware Body & Mind Centre recommends seeking medical advice before taking classes;
Natural hazards and risks may include, but are not limited to, abnormal blood pressure, fainting, hearing loss, heart disease and heart attack, dehydration, heat stroke, physical exhaustion, sprains, muscle strains, shin splints, body strains, blisters, stress fractures, tendinitis, cartilage tears, bursitis, back pain and joint bruises;
All users hereby release Aware Body & Mind Centre and all its shareholders, directors, partners, employees, contractors and service providers from any and all liability for any injury, loss or damage caused or suffered arising out of or in connection with such user’s visit to and/or use of any centre;
The user agrees to be responsible for and to fully indemnify and hold harmless Aware Body & Mind Centre or any relevant third party (including but not limited to Aware Body & Mind Centre’s shareholders, directors, partners, employees, contractors and service providers) from any loss, damage or expense (including legal fees) caused or suffered at any time due to the user’s negligence, recklessness, breach of contract or violation of any of these terms and conditions;
For the avoidance of doubt, Aware Body & Mind Centre’s shareholders, directors, partners, contractors and service providers may from time to time assist Aware Body & Mind Centre in facilitating access to and use of the Centre but none of them has any contractual relationship with clients or other users or any liability of any nature to any client or user.
General Terms
If any provision of these Terms and Conditions is held to be unenforceable, such provision will be ineffective only to the extent of the unenforceability, and all other provisions of these Terms and Conditions will remain in full force and effect.
Aware Body & Mind Centre may add to or change the Terms and Conditions from time to time. Such additions or changes shall be deemed to be incorporated into and form part of these Terms and Conditions.
These Terms and Conditions shall be governed by the laws of Hong Kong and Aware Body & Mind Centre and each user submit to the exclusive jurisdiction of the Hong Kong courts.
These Terms and Conditions are available in both English and Chinese versions. In case of any conflict, the Chinese version shall prevail.
